These terms and conditions ("Terms") govern your access to and use of the services provided by 365 Fitness Body Building Club Co ("365 Fitness," "we," "our," or "us") including but not limited to gym facilities, fitness classes, personal training, and any other services offered by 365 Fitness (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. Please read them carefully before accessing or using the Services.

1. Membership and Access

1.1. Membership: Access to 365 Fitness facilities and services requires a valid membership. Membership options, fees, and terms are outlined in separate membership agreements.
1.2. Age Requirement: Users must be at least 18 years old to sign up for membership or use the Services. Minors must be accompanied by a legal guardian or have written consent to use the Services.
1.3. Access Control: 365 Fitness reserves the right to deny or revoke access to the facilities or Services for any reason, including but not limited to violation of these Terms, inappropriate behavior, or failure to comply with club rules.

2. Use of Facilities and Equipment

(Gym membership, fitness classes, personal training, mixed martial arts classes, gym equipment, and accessories)
2.1. Facility Rules: Members must adhere to all posted club rules and regulations while using 365 Fitness facilities. This includes but is not limited to proper attire, equipment usage, and hygiene standards.
2.2. Equipment Usage: Members are responsible for using gym equipment safely and appropriately. Failure to do so may result in injury or damage to property, for which 365 Fitness is not liable.
2.3. Personal Belongings: 365 Fitness is not responsible for lost or stolen personal belongings. Members are encouraged to secure their valuables in provided lockers.

3. Health and Safety

3.1. Physical Condition: Members should consult with a medical professional before beginning any exercise program. 365 Fitness staff are not medical professionals and cannot provide medical advice.
3.2. Personal Safety: Members are responsible for their own safety while using 365 Fitness facilities. In case of injury or medical emergency, members should seek assistance immediately.
3.3. Cleanliness: Members are expected to maintain personal hygiene and cleanliness while using 365 Fitness facilities. Towels and sanitation stations are provided for this purpose.

4. Payments and Fees

4.1. Membership Fees: Membership fees are outlined in the membership agreement and are subject to change with notice.
4.2. Payment Methods: Members must provide valid payment information and authorize recurring payments for membership dues. Failure to pay may result in suspension or termination of membership.
4.3. Refunds: Membership fees are non-refundable except as required by law or as outlined in the membership agreement.

5. Conduct and Discipline

5.1. Respectful Behavior: Members must treat staff and fellow members with respect and courtesy. Discriminatory, harassing, or otherwise inappropriate behavior will not be tolerated.
5.2. Disciplinary Action: 365 Fitness reserves the right to suspend or terminate membership for violations of these Terms or club rules, at its sole discretion.

6. Privacy Policy

6.1. Personal Information: 365 Fitness collects and processes personal information in accordance with its Privacy Policy, available on the club's website.
6.2. Communication: By signing up for membership, you agree to receive communications from 365 Fitness, including promotional offers and updates related to the Services.

7. Amendments and Modifications

7.1. Changes to Terms: 365 Fitness reserves the right to modify or update these Terms at any time. Notice of such changes will be provided through the club's website or via email to members.
7.2. Continued Use: Your continued use of the Services after any modifications to these Terms constitutes acceptance of the updated Terms.

8. Governing Law and Jurisdiction

8.1. These Terms are governed by the laws of the UAE, without regard to its conflict of laws principles.
8.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Jurisdiction.

9. Membership Cancellation

9.1. Eligibility: Cancellation of membership is only permitted for members with an annual subscription.
9.2. Notice Period: A three (3) month  notice is required from the date of the cancellation request. Members must continue to pay membership fees during this notice period.
9.3. Automatic Deductions: After the notice period, any automatic deductions or system errors resulting in overpayment will be refunded by 365 Fitness.
9.4. Authorized Request: The cancellation request must be made by the member (account holder/owner of the membership) and not by the cardholder or payee if they are different individuals.
9.5. Process: All cancellation requests must be submitted in Written or  e-mail to the club’s administration, and confirmation will be provided upon approval.

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be boun  by these Terms. If you do not agree to these Terms, you may not access or use the Services provided by 365 Fitness Body Building Club Co.
